1. Acceptance of Terms
By accessing or using the AI-BI web application (the "Service"), provided by AI-BI Artificial Intelligence ("we," "us," or "our"), you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you agree to these Terms for that organization.
2. User Accounts
- Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Termination: We reserve the right to suspend or terminate accounts that provide false information, violate these terms, or engage in unauthorized activity.
- Unauthorized Use: You must notify us immediately of any unauthorized use of your account.
3. Data Protection (GDPR Compliance)
AI-BI Artificial Intelligence is the Data Controller of your personal information. If you are a resident of the EU or EEA, you have rights to access, rectification, erasure, and data portability. We use Standard Contractual Clauses (SCCs) for international data transfers.
4. Use of the Web Application
We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Service. You may not reverse engineer the Service or use it for illegal purposes.
5. Fees, Payments, and Refund Policy
5.1 Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns and refunds. By making a purchase, you agree to be bound by Paddle's Checkout Buyer Terms and Conditions.
5.2 Subscription Fees & Billing
Access to certain features requires a paid subscription. Fees are quoted in USD and processed by Paddle. Subscriptions are billed on a recurring basis (monthly or annually). Your subscription will automatically renew unless cancelled via your account settings or through Paddle's Buyer Support.
5.3 Consumer Right to Cancel (14-Day Period)
If you are a Consumer (an individual purchasing for non-business use), you have the right to cancel your initial subscription within 14 days from the day after the Transaction date without giving any reason.
- How to Cancel: To exercise this right, you must contact Paddle Support directly at paddle.net or via their contact form.
- Effect of Cancellation: If you cancel within this period, Paddle will reimburse all payments received from you using the same payment method used for the initial transaction.
- Exceptions: This right to cancel does not apply to the supply of Digital Content once the download, stream, or active use of the Service has begun with your consent. For subscription services, this right applies only to the initial subscription and not to automatic renewals.
5.4 General Refund Policy
Outside of the 14-day statutory period, refunds are provided at the sole discretion of Paddle on a case-by-case basis. Requests for refunds due to technical malfunctions should be directed to Paddle's support team.
5.5 Chargebacks and Disputes
You agree to contact Paddle or AI-BI support prior to raising a request for a chargeback or any dispute with your bank. We reserve the right to suspend or terminate your account if a chargeback is initiated without merit or prior communication.
6. Service Availability & "As Is" Disclaimer
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted or error-free.
7. Limitation of Liability
To the maximum extent permitted by law, AI-BI Artificial Intelligence and Paddle.com shall not be liable for any indirect, incidental, or consequential damages resulting from your use or inability to use the Service.
8. Governing Law
These Terms shall be governed by the laws of the State of Israel. However, your transactions with Paddle.com may be subject to the jurisdiction specified in Paddle's Buyer Terms.
